House Votes to Authorize John Boehner’s planned lawsuit against President Obama over the Affordable Care Act
BREAKING NEWS- POLITICS- Paul Gordon Collier- The House passed a resolution Wednesday that gave Speaker Boehner (R-OH) the consent of the House to proceed with efforts to sue the President over executive orders. This is the first time in American History that the House of Representatives has moved to bring a lawsuit against a President, let alone a sitting president. The House resolution passed along party lines, with five republicans voting against it.
The five Republicans who voted against it were Paul Brown of Georgia, Scott Garret of New Jersey, Walter Jones of North Carolina, Thomas Massie of Kentucky and Steve Stockman of Texas.
Speaker Boehner is bringing a lawsuit against President Obama over what he alleges is Obama’s overreach of authority. He charges that his ‘unilateral’ changes to the Affordable Care Act violate congress’ power to originate and pass legislation, that the President’s primary job as commander in chief, to faithfully enforce the laws of the land, is not being met.
If the suit succeeds, significant portions of the Affordable Care Act, the portions the President changed through executive orders, would be deemed unconstitutional as such changes would need to come through congress, not the President.
Speaker Boehner said, “this isn’t about Republicans and Democrats. It’s about defending the Constitution that we swore an oath to uphold. Are you willing to let any president choose what laws to execute and what laws to change? Are you willing to let anyone tear apart what our Founders have built?”
Democrat House Minority Whip Steny Hoyer countered, “Republicans want to sue the president for not enforcing a law they want to repeal.”
