Sell Guns Online- A Brief Guide- STAFF
Selling guns online in America can seem quite daunting to some people, What are the legal issues, how to you ship them, how do people pay for guns online, and how can you be sure you are not running afoul of the law?
One site where selling guns online is simple, and the whole management of the site is quite to deal with, is “Gun Palace”. In addition to a great name, users find the interface to be very user friendly and other users to be helpful. Gun Palace is an a gun auction site where you can sell shotguns, sell handguns, and sell rifles, along with other types of gun, parts and accessories.
Gun Palace is also a great place to buy guns online, or gun parts and accessories.
So how does the selling process work?
First, consult LOCAL and STATE authorities for rules and regulations. Certain types of guns may not be permitted, and there might be age restrictions as well.
The BUYER must also follow local and state laws, so make sure on any listings that you clarify that. Buyers need to select a local gun shop or business that holds a valid FFL license and that can perform background checks. THIS IS KEY- you only want to ship your gun to an FFL dealer. Any fees they charge are passed on to the buyer, not to you.
Never sell a gun and send it DIRECTLY to an individual. The ATF website has an FAQ on this which states that- A person not licensed under the GCA and not prohibited from acquiring firearms may purchase a firearm from an out-of-State source and obtain the firearm if an arrangement is made with a licensed dealer in the purchaser’s State of residence for the purchaser to obtain the firearm from the dealer.
[18 U.S.C. 922(a)(3) and 922(b)(3)]
It is the responsibility of the purchaser to make this arrangement, however, double check to make sure that you are actually sending your firearm to a licensed dealer. This may involve picking up the phone and calling that business, and looking them up online.
Can you SHIP your firearm?
Here is the ATF’s answer- A nonlicensee may not transfer a firearm to a non-licensed resident of another State. A nonlicensee may mail a shotgun or rifle to a resident of his or her own State or to a licensee in any State. The Postal Service recommends that long guns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms. Handguns are not mailable. A common or contract carrier must be used to ship a handgun.
[18 U.S.C. 1715, 922(a)(3), 922(a)(5) and 922 (a)(2)(A)]
UPS is a “common carrier” and they have a page set up to help you with shipping firearms- http://www.ups.com/content/us/en/resources/ship/packaging/guidelines/firearms.html
Of note, regarding handguns, they state- Handguns, as defined by 18 U.S.C. § 921, will be accepted for transportation only via UPS Next Day Air Services, specifically, UPS Next Day Air® Early A.M.®, UPS Next Day Air®, and UPS Next Day Air Saver®. (Note: UPS Express CriticalSM Service is not available for firearms).
What about listing your firearm?
Follow the prompts for whatever site you are using. Gun Palace has a simple and easy to use interface, for example, but there are some other things you should consider.
First- make sure you include a photo. It goes without saying that including a photo greatly increases your trust.
Second- be detailed, don’t leave fields blank, Potential buyers are concerned about condition, when the firearm was manufactured, its exact brand and model, its caliber, and any other factor.
Third- use good grammar! Nobody is going to check your English or your spelling, and nobody is perfect, but do use proper punctuation, capitalization, and check your spelling, Be simple and direct.
Fourth- DOUBLE CHECK your post, make sure everything you said and wrote was accurate and looks good to the reader. You might even want to have a friend look it over.
Fifth- PROMOTE your post. Share it on your own social media sites, check for rules about firearms, however, email friends, and if you have a website or blog, post a link to your ad. This not only helps you possibly find a buyer, it also might get your listing ranked on Google itself for your particular firearm.
If you select Gun Palace, go here to get started and GOOD LUCK!
