In Europe a senior legal adviser at the EU’s top court has recommended online auction site Ebay should not be liable for trademark infringements committed by its users.
The court’s advocate-general, Niilo Jaaskinen, said Ebay should only be responsible if it has been warned of a user who repeatedly breaches trademarks. The issue was raised by French cosmetics giant L’Oreal, which claimed trademark infringement through sales of goods on Ebay. The court’s judges are expected to rule in a few months.
