As to the whole “Death Panel” deal, and Jim DeMint’s finding that the Senate
legislation includes a provision forcing future Senates to never get rid of, um,
Death Panels, I mean, rationing boards. You know that pointy headed group who
will decide the fates of 300 million Americans? Yeah, them.

Today the Senate of the United States voted on a constitutional point of order
raised by Senators Jim DeMint and John Ensign.

The Senators challenged the constitutionality of the individual mandate in the
Democrats’ health care legislation. The individual mandate is a federally
imposed requirement that every man, woman, and child in the United States obtain
health insurance on pain of financial penalty or, in the Democrats’ proposal,
jail.

Put more plainly, if you chose not to have health insurance, the Congress of the
United States intends to punish you by taking away your property or your life
via incarceration.

All 39 of the Republican Senators still present in
Washington today voted that the




individual mandate is unconstitutional.

Look for House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid to try
to circumvent the traditional conference committee process by which the
different versions of health care reform passed by each house will be
reconciled. If so, it will be the latest example of violating principles of
transparency and accountability in the single-minded pursuit of legislative
victory.

Conferences involving members from both houses are messy things. They are
usually conducted in public and often televised, and can produce a compromise
version of the bill that leaves rank-and-file members tempted to vote against
the final version. That could be perilous in the case of health care since it’s
likely to pass without a vote to spare in the Senate and the House’s version
passed by only five votes.

reports that Sen. Mike Crapo (R-ID) said Republicans are unlikely to be
able to repeal the legislation anytime in the near future.

Said Crapo: “Technically it could be peeled back if the circumstances were
right. But we would have to have a president who would sign such a bill, and we
would have to have 60 votes in the Senate — not just 50. So it would be a very
tall order, and frankly, the likelihood’s that that’s not going to develop in
the near future.”

As I noted yesterday, Democrats are starting to talk up the idea that moving the
implementation of key benefits forward might be one way to ease a final health
care bill through the House of Representatives. The caveat, of course, is that
the earlier the benefits kick in, the more the bill will cost in the
Congressional Budget Office’s initial 10 year window.

This afternoon, Sen. Ben Nelson (D-NE) says that could create problems.

“We’ll just have to look at the numbers,” Nelson told reporters. “I think that’s
what’s the question.”

The Senate of the United States just voted to table Jim DeMint’s proposed
amendment that would prevent cash for cloture compromises.

As you will recall, Ben Nelson was bribed by Harry Reid to vote for the health
care bill via targeted earmarks that will only benefit Nebraska.

DeMint asked for the Senate to suspend its rules to consider his amendment,
which would prohibit such deals in the future.

My, how times have changed.  In 2006, Nancy Pelosi and the Democrats won
majorities in both chambers of Congress by running against the “culture of
corruption,” pledging to operate openly and honestly on Capitol Hill.  Two years
later, Barack Obama rode to victory by pledging to change the way Washington DC
operates, declaring that he would lead the most open and transparent government
ever.  Now Rep. James Clyburn, as House Majority Whip the third-ranking Democrat
in the House, has declared that Republicans
should join Democrats in buying and selling votes rather than complain about the
corruption on Capitol Hill
